1. Introduction

This Privacy Policy explains how MotoAdNetwork ("we," "us," or "the Company") collects, uses, shares, and protects personal information in connection with the website located at motoadnetwork.com (the “Site”) and the services described in our Terms of Service (the "Services").

This Policy applies to everyone who interacts with the Site or the Services: Advertisers and Media Buyers who submit an inquiry or request portal access, Riders whose motorcycle carries a MotoAdNetwork Seat Cover, Location Partners who host our deployments, and general Visitors to the Site. Where a term is capitalized but not defined here, it has the meaning given to it in our Terms of Service.

2. Data Controller

MotoAdNetwork is the data controller responsible for the personal information described in this Policy. MotoAdNetwork's formal company registration in the Philippines is currently in progress; this Policy will be updated with our registered corporate address once registration is complete. You can reach us using the details in Section 16 (Contact).

MotoAdNetwork operates in the Philippines, and the collection and use of personal information described in this Policy is carried out in accordance with Republic Act No. 10173, the Data Privacy Act of 2012 ("DPA"), and its Implementing Rules and Regulations. Depending on the specific information and the context in which we collect it, our basis for processing is one or more of the following:

  • Performance of a contract — for example, processing an Advertiser's contact details to set up portal access and deliver a booked Campaign.
  • Consent — for example, when you voluntarily submit a form on the Site.
  • Legitimate interests — for example, using log files to keep the Site secure and functioning, where this does not override your rights.
  • Compliance with a legal obligation — for example, retaining records where required by Philippine law.

We retain personal information only for as long as necessary for the purposes described in this Policy, to comply with our legal obligations, resolve disputes, and enforce our agreements — see Section 9 (Data Retention) for how this applies to each category of information we collect.

Our business, advertisers, Riders, and Location Partners are Philippines-based, and this Policy — including the rights described in Section 11 — is written under Philippine law (the DPA) accordingly. The EU/UK General Data Protection Regulation (GDPR) does not apply to this Policy: GDPR's territorial scope turns on where data subjects are located or which market a service targets, not on where the underlying hosting infrastructure happens to run — the fact that our website platform (Odoo Online) operates infrastructure based in Europe does not, by itself, bring MotoAdNetwork within GDPR's scope. Should MotoAdNetwork begin serving advertisers or visitors based in the EEA/UK, a GDPR-specific section would need to be added at that time.

4. Information We Collect

We only collect the information described below — collected directly from you through the forms on the Site, or generated automatically as described in Section 4.5 (Log Files).

4.1 Advertisers and Media Buyers

When you request availability or portal access at /see-availability, we collect: Company Name, Contact Person name, Email address, and Phone number (all required). If you later book a Campaign, we also process the billing and campaign details set out in your Order.

4.2 General Contact Form Inquiries

When you use the Contact Us form (/contactus), we collect whatever you provide in the form's Name, Email, Phone, Company, Subject, and Message fields.

4.3 Riders

We do not operate a Rider sign-up form and do not proactively collect personal information from Riders. If you contact us about a Seat Cover on your motorcycle (for example, to request its removal — see our Terms of Service Section 5.3), we process whatever information you choose to share with us in that request, for the sole purpose of responding to it. We do not track your motorcycle's location or movement. See Section 5 below for a clarification about installation photographs.

4.4 Location Partners

We do not operate a Location Partner sign-up form. Cooperation with a Location Partner is arranged directly (offline or through the Contact Us form), and we only hold the contact and site details necessary to coordinate deployments at that location.

4.5 Log Files

Like most websites, our hosting infrastructure automatically logs standard technical information when you visit the Site — IP address, browser type, internet service provider, date/time stamp, referring/exit pages. This information is not linked to your identity and is used only for site security, troubleshooting, and basic administration.

5. Installation and Verification Photographs — Not Location Tracking

As part of delivering an advertising Campaign, our staff or partners may take photographs when a Seat Cover is installed on, or removed from, a motorcycle, and occasional spot-check photographs afterward, to document that the Campaign was delivered ("Proof of Performance"). These photographs may note the location or venue where the installation took place and the date/time. This is a one-time, event-based record tied to a specific installation or spot-check — it is not GPS tracking, and we do not continuously monitor or log a motorcycle's location or movements. Where reasonably possible, we frame these photographs to focus on the Seat Cover and avoid capturing license plates or identifiable faces.

6. Cookies and Similar Technologies

We currently do not use third-party advertising or analytics cookies, tracking pixels, or web beacons on the Site. The Site runs on Odoo Online, which sets a small number of strictly necessary cookies (for example, to keep you logged in to your Advertiser portal account and to protect forms against cross-site request forgery). These necessary cookies cannot be disabled without breaking core functionality such as logging in. If we ever add analytics or advertising cookies in the future, we will update this Policy and provide the relevant consent/opt-out mechanism first.

7. How We Use Your Information

We use the information described in Section 4 to:

  • Respond to your inquiry and, where applicable, set up and manage your Advertiser portal account;
  • Prepare quotations, Orders, and deliver booked Campaigns;
  • Communicate with you about your request, account, or Campaign;
  • Maintain the security and proper functioning of the Site;
  • Comply with our legal obligations.

We do not sell personal information to third parties, and we do not use Rider or Location Partner information for any purpose other than coordinating deployments and responding to requests.

8. Data Sharing and Third-Party Service Providers

We share personal information only with service providers who need it to help us operate the Site and deliver the Services, under confidentiality obligations, and never for their own independent marketing purposes:

  • Odoo S.A. — our website and business-management platform provider (Odoo Online, SaaS). All Site pages, forms, and the data described in Section 4 are hosted on Odoo's infrastructure. Odoo's own privacy practices are described at odoo.com/privacy.
  • Payment service provider — We intend to use Xendit, a Philippines-licensed payment processor, to handle Advertiser payments; this integration is not yet active. Until then, Advertiser payments are handled by invoice under the terms of your Order. This section will be updated with a description of what payment data is shared once the Xendit integration goes live.

We may also disclose information where required to comply with a valid legal request from a Philippine government authority, or to protect the rights, property, or safety of MotoAdNetwork, our users, or the public.

9. Data Retention

As a general principle, we keep personal information only for as long as necessary for the purpose it was collected: Advertiser inquiries and portal-account data for the duration of the business relationship and any period required afterward for legal, accounting, or dispute-resolution purposes; Contact Us messages for as long as needed to resolve the inquiry; installation/Proof of Performance photographs for the duration required to document a Campaign and respond to any related dispute.

10. Data Security

We take reasonable organizational and technical measures to protect personal information against unauthorized access, alteration, disclosure, or destruction, consistent with the requirements of the Data Privacy Act. No method of storage or transmission over the internet is completely secure, and we cannot guarantee absolute security.

11. Your Rights

Under the Data Privacy Act of 2012, you have the right to:

  • Be informed that your personal information will be, is being, or has been processed;
  • Access your personal information that we hold;
  • Object to the processing of your personal information;
  • Request correction of inaccurate or outdated personal information;
  • Request the erasure or blocking of your personal information where it is incomplete, outdated, false, unlawfully obtained, or used for an unauthorized purpose;
  • Be indemnified for damages sustained due to inaccurate, incomplete, outdated, false, unlawfully obtained, or unauthorized use of your personal information;
  • Data portability, where technically feasible; and
  • Lodge a complaint with the National Privacy Commission (NPC) if you believe your rights have been violated.

To exercise any of these rights, contact us using the details in Section 16 — we will respond within the timeframe required by the Data Privacy Act and its Implementing Rules and Regulations.

12. Location Partners — Requesting Removal or Opt-Out

If you are a Location Partner (or the owner/operator of a venue where a motorcycle carrying a MotoAdNetwork Seat Cover may be parked) and you would like us to stop deployment activity at your site, or to add your site to our internal opt-out list, contact us using the details below. We will make reasonable efforts to honor such requests promptly. This opt-out list is maintained internally and is not a public document.

13. Riders — No Registration, Removal on Request

We do not maintain a registry of Riders or their motorcycles. If a Seat Cover was placed on your motorcycle and you would like it removed, or you want to confirm that you will not receive one in the future, contact us using the details below and we will accommodate your request at no cost to you, consistent with our Terms of Service Section 5.3.

14. Children's Privacy

Our Services are intended for use by adults (see our Terms of Service Section 3, minimum age 18). We do not knowingly collect personal information from children. If you believe a child has provided us with personal information, please contact us and we will take reasonable steps to remove it.

15. Changes to This Policy

We may update this Privacy Policy from time to time. The “Last updated” date at the top of this page reflects the most recent revision. We encourage you to review this page periodically.
